284.3948 Flag Burning: A Flawed Proposal.
This 8-page, 8-source piece argues against legislation protecting the flag from desecration. Against the backdrop of the recent Congressional debate concerning the issue, the author argues that those who seek to protect the flag with legislation are well-meant but fail to see the ramifications of the their actions. The author argues that there has always been a fringe element of society which has sought to criticize the mainstream, and an amendment protecting the flag would be impossible to implement since it's difficult to define what a flag is. It would also legitimize the voices of the fringe, which is small in number and no real threat to the mainstream. The author concludes that violating the free speech of unpopular voices is not constitutional and that Americans should do whatever is necessary to ensure that all voices are heard. 8 pgs. 285.4017 Fighting the Government: Marijuana as Medicine.
This paper is an 8-page, 6-source paper analyzing the issue of marijuana decriminalization for medical purposes. Starting with a discussion of an upcoming Supreme Court ruling, the author provides an analysis of the case for decriminalization, including a recent book full of anecdotal evidence. The author then discusses how the federal government has taken a hard line against marijuana users and even doctors who prescribe the drug. This no-compromises attitude led to a lawsuit in 1997, in which several prominent doctors and patients sued the Drug Czar and Barry McCaffrey for violating their rights when, under Proposition 215, marijuana could be used in California and Arizona for medical reasons. The doctors claimed that they had been threatened by the DEA for prescribing the drug, while patients had been arrested and faced stiff penalties. The case has gone back and forth several times, while Proposition 215 has been suspended. The outcome is unclear, and the author finished the essay by describing how decriminalization necessitates removing marijuana from "Schedule I" status, which is reserved for dangerous drugs which have no medicinal value. 8 pgs. 286.4018 Marijuana Legalization.
This piece is a 6-page, 6-sourced analysis of the arguments concerning the legalization of marijuana for medicinal purposes. This is not a position paper; the author presents both sides of the issue, starting with the case against, then shifting to the case for partial legalization. For both arguments, the author cites statistics and summarizes the overriding logic. The only analytical work in the piece is at the conclusion, where the author, after presenting both sides, suggests that the government needs to conduct more research into the issue so that the facts can be considered. 6 pgs.
